TITLE SEARCH

EASEMENT
This is the right to use a portion of your neighbor’s property, and is officially certified. There are many reasons a property may have an easement. Find this out during your title search.
ENCROACHMENT
This is the opposite of an easement. It is a structure that is using a neighbor’s property without permission. This could be a roof going too far into a neighboring property, an underground septic tank, or even just a bush.
ENCUMBRANCE
This is a claim against a property that has not been fully addressed, such as a mortgage or tax liability. This industry is complex and contains a complex vocabulary. Research and preparation are needed when headed into your property search.
