A homeowner represented by an agent was selling her house in a small town in Washington State. She accepted an offer from a buyer, relocated, and was waiting for the transaction to close. The seller discovered that the buyers had begun moving into the home before the closing date. Concerned, she contacted her agent, who then reached out to the buyers’ agent to address the issue. It was made clear that the buyers should not have had possession of the keys and certainly should not have been moving in—there are several legal reasons why this is problematic.
